                          DR. ERNEST GARLINGTON SUES FOR $20 MILLION


How FAME, WEALTH and POWER Rigged a Criminal Trial to Convict an Innocent Man of Conspiracy of Attempted Murder via an $8.7M Coldwell Banker Real Estate Scandal orchestrated by a Triad Nexus of Families:

I. MOTIVE: Behind the Rigged Trial


The background is complex, but critical to understanding the motives of Revenge, Fear and Money. Dr. Darlene Hopson, now Dr. Darlene Garlington, divorced Dr. Derek Hopson, taking their two children and subsequently marrying Dr. Ernest Garlington. Hating Dr. Garlington, Dr. Hopson blamed him for the divorce. Although Dr. Hopson eventually met and married a wealthy woman, Flora Allen, the mother of NBA Basketball star and UConn legend, Ray Allen, he remained jealousy enraged, refusing to see or speak to his biological children. His rejection of his children resulted from the loving relationship they had established with their stepfather, Dr. Garlington. Motivated by revenge, but no evidence, Dr. Hopson told Prosecutor Zentner that Dr. Garlington had attempted to have him killed.  Shots had been fired into the passenger side of a car he drove, which was  purchased by Ray Allen for his mother. Dr. Hopson convinced Ray Allen that he should be in fear for his mother’s life if Dr. Garlington was not convicted. What if Flora was in the car? Motivated by fear that his mother could be killed if something like this should ever happen again, Ray Allen helped to influence Chief Justice Clifford to ensure Garlington was convicted.

II. CHRONOLOGICAL EVENTS: Real Estate Scheme Aids in Rigging the Trial


August 2005: Ray Allen and his mother-in-law, Jackie Williams (real estate agent), met with the Dolans, long-time friends of Judge Clifford. Allen was interested in purchasing their $8.7M home, but they could not agree on a price at that time. The Dolans were motivated to sell by the likelihood of profiting $2M to $3M, and, moreover, according to Judge Clifford, they were financially stressed by an astonishing $60,000 per month in taxes until the house was sold.


October 2005: Dr. Garlington was arraigned in court for conspiracy of attempted murder of Ray Allen’s stepfather, Dr. Hopson.
October 2006: The Dolans hire Coldwell Banker Real Estate Agent, Susan Clifford (Judge Clifford’s wife), to sell their home – which would result in a $250,000 commission (Motive)


July 2007: Triad Nexus of Families Established. Judge Clifford is assigned the nationally publicized Dr. Ernest Garlington case. The conflict of interest is overwhelming and illegal.

ï‚§ the alleged victim in the case was Ray Allen’s stepfather


August 2007: Ray Allen now takes the opportunity to influence Clifford to rig the trial. Prior to the trial, Allen, through his mother-in-law, Jackie Williams, contacted the Dolans via Coldwell Banker Real Estate Agency to inform the Dolans that her son-in-law (Allen) was still interested in purchasing their home.


October 2007: Trial begins: CAUGHT ON TAPE (discovered after trial). Unaware that their conversation was being recorded, Judge Clifford, Defense Attorney Dow and Prosecutor Zentner are caught on tape during jury selection discussing how Susan Clifford could sell Allen the Dolan’s $8.7M home after the trial. Allen’s phone call to the Dolans immediately before the trial freshly cemented in Judge Clifford’s mind.


October 2007: Clifford, Dow and Zentner removed the only black juror.


November 2007: Dr. Ernest Garlington is found guilty in a rigged trial and sentenced to 33 years, a virtual death sentence even though the alleged victim was neither murdered, nor injured. Judge Clifford stated “this could have been a capital punishment case which would have sentenced Dr. Garlington to death via lethal injection.” (Refer to transcripts) This statement alone is NOT “the appearance of impropriety,” but is, in fact, “IMPROPRIETY.

III. THE COVER UP: Real Estate Scheme of the Rigged Trial


Clifford, Dow and Zentner removed recordings CAUGHT ON TAPE to Cover Up the scandal. Clifford said, “We need money. We’ve got my daughter’s wedding to pay for. My wife better start shaking the money tree.” Dow responds, “Susan and McWaid (a sitting juror) could share the commission ($250K) . . . for your retirement.”


Dow gave Dr. Garlington NO TRIAL DEFENSE and was fired after the conviction. Dr. Garlington hired Boston Attorney, Jeffrey Denner, Harvard Law School graduate and owner of a nationally respected law firm. Denner said, “Dr. Garlington was SOLD OUT by Dow. . . Clifford made prejudicial decisions. Dr. Garlington should have been found INNOCENT.” (refer to transcript from April 7, 2008 hearing, page 21)


Susan Clifford committed FRAUD by forging the Dolan’s signatures to cover up the $8.7M scandal. This is supported by the document proffered by Attorney Zentner is the hearing for the disqualification to the Judicial Hearing Committee – Pre-Evidentiary Hearing Investigation (PHI) Report. The Dolans likely allowed Susan to forge the signatures to Cover-Up this $8.7M scandal.


Dr. Garlington said, “Connecticut courts see me as a N(word) Doctor. They’re covering Up Clifford’s crimes. The system is racist.” Public Defender (PD) DeRosa responded, “That’s true.” Connecticut is ranked highest among all states in racial disparity in mass incarceration of blacks. Susan Clifford coerced Dr. Garlington’s attorney, Attorney Koch, to withdraw from the case. PD Attorney DeRosa stated in court, “Susan Clifford contacted PD Attorney Koch regarding Dr. Garlington’s case.” The presiding Judge (Bright) responded, “I can understand why Mr. Garlington would conclude that the only reason that Judge Clifford’s wife would be calling Attorney Koch would be to pressure him about the case. Dr. Garlington explained the “Susan Clifford knows that her falsified signature is going to become a part of this habeas,” at which time Judge Bright responded by asking DeRosa, “Are you prepared to put Judge Clifford’s wife on the stand and question her about the alleged Fraud and the conversation with Attorney Koch?”


Motive


Susan Clifford’s motive is understandably the fear of being locked up in a federal women’s prison for up to 20 years for FRAUD. Susan Clifford made calls to Public Defender Theodore Koch coercing him to withdraw from the case to avoid being arrested by the FBI for fraudulently forging the signatures of the Dolan’s on an $8.7M Coldwell Banker Real Estate document with the intent to deceive the Superior Court.



Abusing Power


Koch also said in court that Judge Clifford would retaliate if he brought forth the “powerful personal claims” against Clifford that Dr. Garlington had presented, so he had to withdraw. Based on a letter written to Dr. Garlington from Attorney Koch, it appears as if Judge Clifford blackmailed Koch (see Civil Law suit #24) to get off the case.


Additionally, Susan Clifford was arrested in 2004 (Case #0015212) for DUI and CAUGHT ON TAPE becoming belligerent and ripping off some of her clothes in front of the camera and “exposed her upper torso several times.” She exposed her breasts to the Madison Police Department (see police report # CFS No. 030000-12873, Incident CD 2101). Judge Clifford thwarted the prosecution while he formed a committee to expunge DUI charges – abusing his power.


Public Defender Services (PDS) appointed three attorneys, McIntyre, Koch and DeRosa, to Dr. Garlington’s case. However, they refused to expose the crimes perpetrated by the judicial system and helped to cover-up the crimes and unethical practices in the $8.7M Coldwell Banker Scandal. This overall neglect of judicial responsibility prevented Dr. Garlington from proving his innocence. By hiding the truth, the PDS revoked Dr. Ernest Garlington’s Constitutional Rights and Civil Rights to fair and unbiased representation. On May 2, 2008, Dr. Garlington was sentenced to 33 years after being wrongly convicted of a crime he did not commit.


On May 2, 2017, after nine years of false imprisonment, Dr. Garlington asked the Federal Bureau of Investigation (FBI) to initiate an investigation into the conspiracy mentioned in the above press release.


On May 2, 2017, Dr. Garlington asked the Department of Justice - Civil Rights Division to open an investigation.


On May 2, 2017, Dr. Garlington filed a $20,000,000 lawsuit against Susan Clifford and Coldwell Banker.
Were it not for Judicial immunity of Judge Clifford and Prosecutorial immunity of States Attorney Russell Zentner, they would also be defendants in Dr. Garlington’s Federal Civil Lawsuit.
